ADMINISTRATOR: BESPOKE SPORTS & ENTERTAINMENT, 1900 W. Moorehead Street, Suite 101, Charlotte, NC 28208 (the "Administrator").
TIMING: The Home of the Beans - Bush's Austin Takeover Campaign ("Campaign") begins on or about 12:00 PM Central Daylight Savings Time ("CDT") on October 2, 2025 and ends whenever the first three hundred fifty (350) requests for one (1) Bush's Beans "Home of the Beans" ticket are claimed or on October 10, 2025 whichever occurs first ("Campaign Period")
ELIGIBILITY: This Campaign is open to legal residents who reside within one hundred fifty (150) miles of Austin, Texas and who are at least eighteen (18) years of age or older (individually defined as an "Participant" and collectively defined as "Participants"). Employees, officers, and directors of Sponsor, Administrator and each of their parent and affiliated companies, subsidiaries, distributors, retailers, dealers, sales representatives, their advertising and promotion agencies, and any and all other companies associated with the Campaign (collectively, the "Campaign Entities"), and each of their immediate family members and/or people living in the same household are not eligible to participate. All eligibility is subject to all U.S. federal, state and local laws and regulations. Sponsor's database clock will be the timekeeper for this Campaign.
HOW TO REQUEST ONE (1) TICKET FOR THE BUSH'S BEANS "HOME OF THE BEANS" EVENT ON OCTOBER 10, 2025: During the Campaign Period, (a) Use your mobile phone or other web-enabled device to scan the Campaign quick response ("QR") code featured on specially-marked Bush's Beans promotional materials and/or designated emails, which will take you to homeofthebeans.com; OR (b) Without scanning the QR code, visit homeofthebeans.com and follow all prompts and instructions regarding how to complete and submit the ticket request form. To complete the ticket request form, submit your complete name, mailing address including zip code, a valid email address, and the telephone number you frequently use (individually defined as an "Ticket Request" and collectively defined as "Ticket Requests"). Limit one (1) Ticket Request per person. You may not use multiple email accounts to circumvent the Ticket Request limit. Duplicate Ticket Request or multiple Ticket Requests made by a Participant in excess of the number allowed will be deemed void and will not be honored.
Ticket Requests will not be acknowledged or returned, and the Sponsor has the right to dispose of Ticket Requests at Sponsor's sole and absolute discretion. Sponsor has the right to deny any and all Ticket Requests that are duplicate Ticket Requests or subject to any fraudulent activity. Sponsor is not responsible for any lost, late, misdirected Ticket Requests or Ticket Requests that have been tampered with or not obtained through legitimate channels, all of which will be disqualified. Mechanically reproduced Ticket Requests or Ticket Requests generated or submitted with the use of a robotic, automated, macro, or script device, or other automated means or any other means intended to impact the integrity of the Campaign as determined by Sponsor in Sponsor' sole and absolute discretion may be determined as void. Use of automated entry or similar devices as defined herein but not limited to, aggregator sites and or provided links, or contracted services, which are used to participate, "game" or subvert the Ticket Request process is prohibited and all Ticket Requests submitted or otherwise effectuated through such devices are void and will not be honored in any way. Persons found tampering with or abusing any aspect of the Campaign, or whom Sponsor believes to be causing malfunction, error, fraudulent activity of any kind, disruption or damage will be eliminated from the Campaign. Sponsor is not responsible for illegible, incomplete or stolen Ticket Requests or Ticket Requests that are processed late or are lost, stolen or deleted due to computer or electronic malfunction or other error. By submitting a Ticket Request, each Participant agrees to abide by these Terms and Conditions. Sponsor will not assume responsibility for any third party's failure to act in accordance with its instructions pertaining to Campaign implementation.
Ticket Requests submitted by any Participant who does not meet the eligibility requirements (including all requirements with respect to age and residence), as determined by Sponsor in its sole and absolute discretion, may be disqualified. By participating in the Campaign, each Participant unconditionally accepts and agrees to comply with, be bound by and abide by these Terms and Conditions, and the decisions of the Sponsor and/or the Administrator, whose decisions shall be final and legally binding in all respects.
UP TO THREE HUNDRED FIFTY (350) BUSH'S BEANS "HOME OF THE BEANS" TICKETS WILL BE DISTRIBUTED. Up to three hundred fifty (350) Participants who submit a Ticket Request will receive one (1) general admission ticket to Bush's Beans "Home of The Beans" Event taking place at Antone's located at 305 E. 5th Street in Austin, Texas on October 10, 2025 (individually defined as "Ticket Recipient" and collectively defined as "Ticket Recipients"). The approximate retail value ("ARV") of each Bush's Bean's "Home of the Beans" Event ticket ("Event Ticket"): $75. Each Ticket Recipient will receive one (1) Event Ticket from [email protected] to the email address submitted on the Ticket Request form by October 10, 2025. Ticket Recipients are solely responsible for any and all air and ground transportation, tolls, gasoline, parking, mileage, meals, personal incidentals and lodging (if necessary) to travel to the Bush's Beans "Home of The Beans" Event venue at Antone's in Austin, Texas on October 10, 2025. Event Tickets may not be exchanged for cash and cannot be transferred, bartered, sold. In the event, for whatever reason, the Bush's Beans "Home of the Beans" Event scheduled on October 10, 2025 is postponed or cancelled, the tickets to the Bush's Beans "Home of the Beans" Event will not be offered and no compensation will be made in lieu of the cancelled tickets. The value of the Bush's Beans "Home of the Beans" Event Ticket set forth above represents Sponsor's good faith determination of the approximate retail value thereof, and the actual fair market value, as ultimately determined by Sponsor, is final and binding and cannot be challenged or appealed. In the event the stated approximate retail value of the Bush's Beans "Home of the Beans" Event Ticket is more than the actual fair market value of the ticket, the difference will not be distributed in cash or otherwise. There is no cash alternative for any Bush's Beans "Home of the Beans" Event Ticket, in whole or in part. No cash compensation, refunds, or alternatives will be offered due to a Ticket Recipient's inability to attend, claim, or use the ticket. In no event shall the Sponsor be obligated to distribute more tickets other than the number of tickets stated in these Terms and Conditions. Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize including but not limited to its quality, fitness for purpose or mechanical condition. During the Bush's Beans "Home of the Beans" Event on October 10, 2025, if a Ticket Recipient engages or has engaged in behavior that is obnoxious, threatening, disruptive, inappropriate, illegal, or acts with the intent to annoy, abuse, threaten, or harass any other person, as determined by Sponsor in its sole discretion, Sponsor and/or the Event Staff reserve the right to remove the Ticket Recipient immediately from the grounds of the Bush's Beans "Home of the Beans" Event without further compensation.
GENERAL CONDITIONS: Event Tickets will be distributed only if the Participants fully comply with these Terms and Conditions. Ticket Recipients shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the tickets. Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any ticket distributed in connection with the Campaign. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH EVENT TICKETS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
GENERAL CONDITIONS/LIABILITY RELEASE/FORCE MAJEURE: Each Participant and Ticket Recipient agree that the Campaign Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Campaign or any Campaign-related activity, or from Ticket Recipient's acceptance, receipt, possession and/or use or misuse of any ticket, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the an Event Ticket, including, without limitation, to such Event Ticket's quality or fitness for a particular purpose. The Campaign Entities assume no responsibility for any damage to a Participant's or any other person's, computer system which is occasioned by participating in the Campaign, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, the Campaign Entities are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen Ticket Requests or digitally transferred ticket notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole and absolute discretion to disqualify any individual who is found to be tampering with the Ticket Request process or the operation of the Campaign, to be acting in violation of these Terms and Conditions, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Campaign, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. If a dispute as to the identity of the individual who actually submitted a Ticket Request cannot be resolved to Sponsor's satisfaction, the affected Ticket Request may be deemed ineligible. Sponsor reserves the right to modify, extend, suspend, or terminate the Campaign if it determines, in its sole and absolute discretion, that the Campaign is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor's control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Campaign as contemplated herein. In the event an insufficient number of eligible Ticket Requests are received and/or Sponsor is prevented from distributing all Event Tickets or continuing with the Campaign as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, windstorm, epidemic, pandemic, public health crisis, disease, virus, sickness or outbreak or other similar or dissimilar natural disaster; act of God or public enemy; riot or civil disturbance, act of any government or governmental authority, power failure, satellite or equipment failure, failure of telecommunications lines or failure or breakdown of plant, machinery or vehicles operated by a third party; labor dispute, strike, or lockout; actual or threat of war, armed conflict, terrorist attacks, war (declared, undeclared or threatened), explosion, nuclear, or chemical or biological contamination; or a government imposed travel ban, restriction on movement or gatherings, or other government imposed mandate of any kind, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), Sponsor reserves the right to modify, suspend, or terminate the Campaign. If the Campaign is terminated before the end of the Campaign Period, Sponsor may (if possible) select the Ticket Recipients in a random drawing from all eligible, non-suspect Ticket Requests received as of the date of the event giving rise to the termination of the Campaign. Inclusion in such drawing shall be each Participant's sole and exclusive remedy under such circumstances. Only the type and quantity of Event Tickets described in these Terms and Conditions will be distributed. If, for any reason, more bona fide Ticket Recipients come forward seeking to claim Event Tickets in excess of the number of Event Tickets set forth in these Terms and Conditions, or remaining Ticket Recipients, as the case may be, of the advertised number of Event Tickets available in question may be selected in a random drawing from among all persons making purportedly valid claims for such Event Tickets. Inclusion in such drawing shall be each Participant's sole and exclusive remedy under such circumstances. These Terms and Conditions cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
MISCELLANEOUS: The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision. In the event that any provision of these Terms and Conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Terms and Conditions will not constitute a waiver of that provision. Participants agree to waive any rights to claim ambiguity of these Terms and Conditions. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Campaign-related materials, privacy policy or terms of use on any website, social media platform or application and/or the Terms and Conditions, the Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Sponsor's sole and absolute discretion.
